Consultation: Mobile terminal licence exemption regulations update

This statutory consultation invites comments on whether the proposed Wireless Telegraphy (Exemption)(Amendment) Regulations 2025 correctly implement Ofcom’s policy decisions to licence exempt certain mobile terminals from the need to hold a Wireless Telegraphy Act 2006 licence.

To manage this resource effectively, Ofcom is empowered under the Wireless Telegraphy Act 2006 (the “WT Act”) to grant licences for the use of radio frequencies. We do this to ensure that the radio spectrum is used efficiently and without harmful interference between different users. However, not all wireless devices require a licence and under section 8(4) of the WT Act Ofcom has a duty to create regulations that exempt specific types of equipment from the need to hold such a licence if certain conditions are met. Ofcom also has a general power to allow the licence exempt use of other wireless devices where it considers it appropriate to do so.

Licence exemption supports the development and take up of wireless technologies and reduces the regulatory burden on manufacturers and users, encouraging the introduction of new and innovative products to the market. We periodically review the licence exemptions that are in place to reflect changes in technology and usage patterns, to safeguard the efficient use of the radio spectrum and to remove disproportionate regulatory burdens.
